Current Position: Home > IP News > Is the product labeled with "green trademark" green?

The brand of "green food" is pasted on the food, which will make consumers feel at ease when buying. But are some foods labeled "green food" really green? Note that some certification trademarks are illegally printed by private engraving molds!
In July this year, the food, drug and Environmental Investigation Corps of the Shanghai Municipal Public Security Bureau further promoted the "100 day action" and "sharpening sword" series of special actions to crack down on and rectify the summer. It cracked the first case of counterfeiting the "green food" certification trademark of the Ministry of agriculture and rural areas in China, arrested 11 suspect, smashed more than 10 production, storage and marketing dens, and seized more than 300000 counterfeit "green food" certification trademarks, with a sales amount of more than 2 million yuan.
”It is the quality certification standard for high-quality agricultural products formulated and implemented by the Ministry of agriculture and rural affairs in 1990; The "green food" trademark is a symbol to prove that food is pollution-free, safe, high-quality and nutritious. As an intangible asset of an enterprise, the role of this trademark in modern production and circulation is increasingly valued by people.
In 1992, "green food" was officially approved and registered by the green food development center of the Ministry of agriculture and rural areas as the first certification trademark in China and protected by the trademark law.
微信图片_20220818230653.jpgAccording to relevant regulations, agricultural product production enterprises can use the certification trademark of "green food" on the outer packaging of their agricultural products only after they have been tested, reviewed and authorized by the green food development center of the Ministry of agriculture and rural areas.
In this case, in order to seek illegal benefits, the suspect illegally printed the fake "green food" certification trademark in a mold without authorization of the green food development center of the Ministry of agriculture and rural areas, and pasted the fake trademark on the outer packaging of ordinary agricultural products such as strawberries, grapes and rice produced by himself or purchased at a low price, thereby falsely increasing the quality level of agricultural products, And then sell at a price more than 50% higher than that of ordinary agricultural products, so as to achieve the purpose of improving profits.
Such production and operation obviously infringes upon the exclusive right to use registered trademarks. The measures for the administration of green food marks also stipulates that no unit or individual may forge or transfer green food marks and their use certificates.
From the perspective of market and consumption, the counterfeiting of the certification trademark of "green food" is to fish in troubled waters under the pretext of "green food" by taking advantage of people's psychology of pursuing health and safety, thus causing chaos to the "green food" market;
At the same time, this is also a kind of unfair competition behavior - taking improper means to engage in market transactions may crowd out competitors and also damage the interests of the real "green food";
It will also mislead the vast number of consumers, which is suspected of consumption fraud and is a violation of the consumer rights and interests protection law.
Those who pass ordinary food off as "green food" must be rectified and attacked without mercy, so as to ensure that "green food" is really safe, high-quality and nutritious food, protect the legitimate "green food" brand, and promote the healthy development of the "green food" market.
In addition to the fact that the certification trademark of "green food" can not be printed at will and that "green food" can not fish in troubled waters, there is also a phenomenon that "green food" has "extended service".
According to the regulations, the right to use the "green food" logo is valid for three years from the date of approval. If it is required to continue to use it, it must be re declared within 90 days before the expiration of the validity period. If it is not re declared, it shall be deemed that the right to use it is automatically abandoned.
However, the phenomenon of using the expired failure flag still exists. This is the same as the false use of the "green food" logo. It is an act of misleading consumption and should also be cleaned up and rectified.
Some consumers mistakenly think that the "green food" sign is a lifelong system, which should also be corrected by popularizing relevant knowledge. Safe and assured "green food" can bring real safety to the masses.
