Documents required for patent application of utility model patent

1. Utility model patent request

2. Description (if there are attached drawings in the description, the attached drawings shall be submitted)

3. Claims

4. Abstract (the attached drawings shall be provided if necessary)

5. Letter of attorney for patent agency

6. If applying for fee mitigation, a request for fee mitigation and corresponding supporting documents shall be submitted. (only applicable to individual applicants and non-profit organizations in mainland China)

In China, only the preliminary examination system is implemented for utility model and design patent applications.

In the process of preliminary examination, the examiner will issue a notice of amendment to the form problems in the application documents. The applicant shall make corrections according the notice.

After passing the preliminary examination, the examiner will issue a patent grant notice. After receiving the patent grant notice, the applicant shall go through the following registration procedures:

Pay the patent registration fee, annual fee of the year of authorization, announcement fee and certificate fee within the prescribed time limit. The applicant can obtain the patent certificate after going through the registration procedures.
