Recently, the State Council has approved a new round of comprehensive opening-up of service areas in Beijing. There are 26 major tasks in 4 categories proposed in the work program, among which, relevant measures related to intellectual property work are summarized as follows:

(1) We will deepen reform and open up in key service industries.


2. Promote the development of digital economy and digital trade. We will accelerate the opening of public data, guide social institutions to open their own data in accordance with the law, support Beijing to carry out data cooperation between central and local governments in specific fields, and promote the docking of government data and social data platforms. Study the methods and models of domestic and foreign digital trade statistics, and build a digital trade statistics system combining statistical data and enterprise cases. (3) To form a system of institutional innovation in line with international standards.


18. Improve fiscal and tax support policies. When enterprises engaged in R & D of integrated circuits, artificial intelligence, biomedicine, key materials and other fields in Beijing are identified as high-tech enterprises, if they have worked for more than one year and the proportion of the total R & D expenses incurred in China to the total R & D expenses is no less than 50%, the "approval upon filing" shall be implemented. If a high-tech enterprise is identified as a high-tech enterprise, it can enjoy the relevant policies such as preferential income tax according to the provisions, strengthen the supervision during and after the event, and deal with those that do not meet the standards for the identification of high-tech enterprises according to the relevant provisions. The reply is as follows:

Work plan for deepening a new round of comprehensive pilot projects of Beijing's service industry's opening up and opening up

This work plan is formulated to implement the decision and deployment of the CPC Central Committee and the State Council on deepening the comprehensive pilot project of Beijing's new round of service industry opening-up and promoting the high-quality development of the service industry.

1、 General requirements

2、 Development goals

By 2025, we will basically improve the policy and institutional system for expanding the opening up of the service industry focusing on Trade and investment facilitation, further optimize the market-oriented, legalized and international business environment, significantly enhance the competitiveness of the industry, and effectively prevent and control risks, so as to provide a stronger demonstration and guidance for the expansion and opening up of the national service industry.

By 2030, we will achieve free and convenient trade, free investment, cross-border capital flow, talent employment, transportation, and safe and orderly flow of data. We will basically build an open service industry system that is connected with international high-standard economic and trade rules, and the economic model and international competitiveness of the service industry will enter the forefront of the world.

3、 Main tasks

(1) We will deepen reform and open up in key service industries.

1. Deepen the reform of science and technology services. Support the development of maker space and entrepreneurial base by means of free subsidies, business awards and subsidies. We will deepen the reform of the right to use, dispose of and profit from scientific and technological achievements, carry out pilot projects to give scientific research personnel the ownership or long-term use right of scientific and technological achievements, and explore the formation of market-oriented empowerment, achievement evaluation, and income distribution systems. We will support the construction of major science and technology infrastructure in Beijing, where the Ministry affiliated institutes are located, and create a smart city.

2. Promote the development of digital economy and digital trade. We will accelerate the opening of public data, guide social institutions to open their own data in accordance with the law, support Beijing to carry out data cooperation between central and local governments in specific fields, and promote the docking of government data and social data platforms. 3. Strengthen the reform and innovation in the field of financial services. We will promote the reform of "separation of certificates and licenses" in the financial sector and implement relevant policies in Beijing. We will support social capital in establishing and leading the operation of RMB international investment and loan funds in Beijing, and support foreign investment institutions to participate in overseas investment pilot projects of qualified domestic limited partners. We will thoroughly implement the pilot project of qualified overseas limited partners and gradually release the restrictions on the scope of investment in the open market. According to the central government's deployment, further promote the reform of the new third board, comprehensively implement the registration system, effectively improve the liquidity of the new third board market, and create a platform for serving small and medium-sized enterprises. Establish a domestic listing service platform for foreign-invested enterprises and provide relevant services. Support wholly foreign-owned enterprises to apply to become private fund managers and carry out equity investment and asset management business. Qualified private securities investment fund management companies can apply to become public fund management companies. Give priority to allowing multinational companies to set up wholly foreign-owned financial companies in Beijing. Support qualified financial companies in Beijing to obtain the qualification of foreign exchange settlement and sales business, and carry out buyer's credit and extend industrial chain financial business under the premise of legal compliance and controllable risk. We will support more foreign banks to obtain the qualification of securities investment fund custody. We will study how to allow foreign banks in Beijing to carry out treasury bond futures trading in a timely manner. Qualified foreign banks are allowed to participate in domestic gold and silver futures trading. We will support foreign-funded corporate banks with a certain scale and stable operation in Beijing to apply for participation in open market transactions. Foreign banks are allowed to obtain the gold import license of the people's Bank of China and the lead underwriting qualification of the inter-bank bond market. Support related enterprises to engage in third-party payment business through market-oriented operation such as acquisition and equity participation. Support securities companies to engage in Shanghai Luntong China depository receipt business. The pilot project of comprehensive financial operation should be carried out prudently and orderly. We will promote the legal compliance of bulk commodity trading venues such as Beijing iron ore trading center, explore various trading methods such as non-standard warehouse receipt trading, and establish a scientific and reasonable commodity pricing mechanism.

4. Promote the opening up of Internet information services. We will open up domestic Internet virtual private network services to foreign investors (the proportion of foreign shares shall not exceed 50%), and attract overseas telecom operators to provide domestic Internet virtual private network services for foreign-invested enterprises in Beijing by establishing joint ventures. We will support the application of Internet of vehicles (ICV) and automatic driving map, and build the highway of Beijing Shanghai Internet of vehicles. We will explore the establishment of a website filing system to meet the needs of overseas customers.

5. Promote the upgrading of business, cultural and tourism services. We will support Wangfujing pedestrian street in creating an international consumption environment, a high-quality business environment, and creating an international consumption area. Optimize the layout of duty-free shops in the city, coordinate and set up departure pick-up points for duty-free shops in the airport isolation area

6. Promote the opening up of education services. We will increase the supply of international education, improve the layout of schools for children of foreigners, and allow primary and secondary schools to accept children of foreign personnel to enter schools in accordance with the relevant provisions of the state. To explore the introduction of international teaching materials for examination institutions and science and engineering. Encourage foreign investment in adult education and training institutions, and support foreign investment in establishing business vocational skills training institutions. We will promote a number of international cooperation demonstration projects in vocational education.

7. Improve the ability of health and medical services. We should moderately relax the management of small doses of special chemical agents for pharmaceutical research and development. Support the establishment of international research hospitals or R & D beds, and accelerate the incubation and transformation process of pharmaceutical R & D achievements. 8. Promote the opening up and reform of professional services. We will explore how to set up branch offices in pilot free trade zones. We will explore the establishment of a mechanism for recognition of past qualifications, allowing qualified professionals in finance, architectural design, planning and other fields with overseas professional qualifications to apply for work residence certificates in accordance with the regulations and serve in the administrative region of Beijing. 10. Relying on Zhongguancun National Independent Innovation Demonstration Zone, build venture capital cluster area. 11. Build a digital trade development leading area based on "one park, one district". Based on Zhongguancun Software Park, we will promote international mutual recognition of digital certificates and electronic signatures, pilot cross-border data flow, build an international information industry and digital trade port, and explore the establishment of a regulatory system based on software real name certification and data origin label identification. Foreign investment should be encouraged to participate in the provision of software as a service in accordance with laws and regulations. 14. To create a financial technology innovation demonstration area with Financial Street, national financial science and technology demonstration area and Lize financial and business district as the main positions. We will further support the development of financial science and technology innovation activities in accordance with the law. We will support financial institutions and large-scale science and technology enterprises to set up financial technology companies in accordance with the law. 5. Support the development of cultural innovation based on the national cultural and financial cooperation demonstration zone and the national cultural industry innovation experimental zone. 17. Promote the liberalization and facilitation of investment and trade. Support the trial implementation of the negative list management mode of cross-border service trade in specific regions, and relax the market access restrictions of service trade under the modes of cross-border delivery, overseas consumption and natural person movement. Expand the "single window" service area, comprehensively improve the business application rate, and strengthen the construction of characteristic functions. 22. Carry out policy linkage innovation. (4) We should optimize the supply of factors for the open development of the service industry.

23. Facilitate cross-border capital flow. We will carry out pilot projects for the integration of local and foreign currencies in specific areas of Beijing. To study and promote foreign investors to use a domestic foreign exchange account of RMB overseas institutions to handle domestic securities investment matters. For overseas institutions that can carry out spot settlement and sales of foreign exchange according to regulations, banks in specific areas of Beijing can handle RMB and foreign exchange derivatives transactions for them. We will carry out pilot projects to facilitate the payment of capital account income in the whole city. We will explore and carry out a pilot project of integrating domestic and foreign currency cross-border capital pools, and implement two-way macro Prudential Management of cross-border capital flows. Support qualified foreign trade comprehensive service enterprises to provide comprehensive foreign exchange services for cross-border e-commerce. 24. Standardize the safe and orderly cross-border flow of data. We will explore the establishment of data security management mechanisms such as data protection capability certification, and promote the pilot project of data exit security management and evaluation. We should formulate the public data management measures of Beijing, improve the data classification and classification security protection system, and accelerate the formation of an innovative supervision system in the open environment in terms of data circulation and data security supervision. 25. Provide convenience for international talents to work and live. Overseas high-end talents will be given entry-exit convenience to facilitate their legitimate income under domestic current account to purchase and remit foreign exchange under personal family support funds, and facilitate them to settle foreign exchange beyond the facilitation limit and pay the tuition fees of their accompanying children in international schools in China. We will optimize the examination and approval process of work permit and residence permit for foreigners, and gradually realize the "one window acceptance and simultaneous evidence collection" of work permit and work residence permit for foreign talents. 26. Improve land support and technical support. In line with the requirements of land space planning and use control, we should promote the reasonable conversion of different industrial land types. 4、 Organization and Implementation

If the pilot needs to temporarily adjust and implement some provisions of relevant administrative regulations, documents of the State Council and departmental rules approved by the State Council, it shall be handled in accordance with the prescribed procedures. The Beijing Municipal People's government and the Ministry of commerce should timely sort out and study the new situation and problems in the construction of the comprehensive demonstration zone, constantly adjust and optimize measures, and timely report major issues to the State Council.
